Complain to the adviser or the bank

05 Mis-sold ISA claims
An ISA is a tax wrapper. The complaint is almost never about the wrapper — it is about what the adviser put inside it, what they charged, and what they told you about the risk. Because ISAs are familiar, the suitability conversation often never happened at all.
Short answer
An ISA complaint argues that the investment held inside the ISA was unsuitable for you, or that the charges and risks were not explained fairly. The wrapper itself is rarely the problem. Complain to the firm that recommended or sold it; the Financial Ombudsman Service is free if you are unhappy with the answer.
Indicators only. Not legal or financial advice. Not a prediction of outcome.
CAVEAT EMPTORlet the buyer beware — a defence that has limits
01 Is this you?
A claim is worth pursuing when the facts line up. These are the facts that matter most for this product. If three or more describe your situation, the checker is worth five minutes.
02 How it works
Two ISAs can look identical on a statement and be entirely different investments. Identify the actual holdings: the funds, the strategies, the risk ratings. Then identify the cost of each layer — the platform fee, the fund ongoing charge, any advice charge, and any dealing or exit cost. Complaints about charges usually get stronger once the layers are added up rather than looked at one by one.
An attitude-to-risk questionnaire records what you were willing to accept. It does not record what you could afford to lose. Where savings held for a short-term purpose were invested for the long term, or where a cautious saver was placed in a volatile fund, the mismatch between the money’s purpose and the product’s horizon is often the clearest part of the case.
A recommendation to move out of an existing holding is a recommendation in its own right, and it needs its own justification. Was there an exit cost? Was the old holding cheaper? Was the switch motivated by a charge payable to the firm? Ask for the switch analysis, and for any commission or fee disclosure that accompanied it.
Banks and platforms often record a sale as execution-only when the customer reasonably thought they were being advised. That single record decides how the complaint is argued, so get it before you write. If the firm says you chose without advice, ask what it did to make that clear to you at the time.
Loss here is usually the difference between your position and the position suitable advice would have produced — commonly a comparable holding, or the original investment had it been left alone. That calculation needs documents, not estimates, which is why the checker deliberately never produces a figure.

04 The routes
Free. Ask for the suitability report, the recorded attitude to risk, the switch analysis and the full cost disclosure at the same time as making the complaint.
Free to consumers, and used to dealing with bank and platform complaints where records are thin and recollections differ. It looks at what is fair as well as what the rules require.
Where the firm has failed. Free to claim, up to £85,000 per eligible person, per firm for firms that failed after 1 April 2019, and not for performance complaints alone.
Usually reserved for larger losses. A statutory claim under section 138D of the Financial Services and Markets Act 2000 is often pleaded alongside negligence.
05 Evidence
You do not need everything before you start. But a complaint that names dates, amounts and documents is much harder to answer with a template letter.
06 Questions
The wrapper itself rarely is. What can be mis-sold is the investment held inside it and the advice around it: a fund that did not suit the saver, charges that were not disclosed, or a switch that was not justified. Many complaints are, in effect, about the fund and not the ISA.
Only in that it explains why a large sum was invested quickly at the end of a tax year. Speed is not itself a problem, but a recommendation made to hit a deadline rather than suit the investor is worth asking about in writing.
Not on its own. FSCS cannot accept claims that are only about poor investment performance, and an Ombudsman case based purely on a fall in value will usually fail. The question is whether the holding matched your circumstances and what you were told about the risk.
Firms are expected to keep records of the advice they give and to be able to show it on request. If a firm says it has nothing from the period, ask again in writing and note the answer — what a firm can and cannot produce is itself part of the picture.
Yes. A transfer recommendation is a recommendation. Ask for the comparison that supported it, including exit costs, a change in charges and any benefit to the firm.
No. Complaining and encashing are separate decisions. Take independent advice before making any change to the investment itself, because it can affect what you can recover.
