RSK Risk and disclaimer

The limits of this site, stated plainly.

Everything here is general information. It is not legal, financial or investment advice, it is not a prediction, and it is not a valuation. Where a route can fail or cost you money, this page says so on the page rather than in a footnote.

01

The checker is an indicator, not advice

It applies eight documented checks to the answers you give. It does not know your file, it cannot weigh evidence, and it cannot tell you whether a complaint will succeed. A high number of flags is not a stronger case; it is a longer list of questions to ask.

02

We do not value claims, and no one honestly can at this stage

Compensation depends on what a suitable alternative would have produced, what you would have done, and what the file shows. That comparison needs documents we have never seen. Any figure you are offered before someone has read your file is a guess presented as information.

03

The Ombudsman’s award limit is a ceiling, not a target

£455,000 for complaints referred to the Financial Ombudsman Service on or after 1 April 2026 about acts or omissions that occurred on or after 1 April 2019. For acts or omissions before 1 April 2019, the limit is £205,000 for cases referred on or after 1 April 2026. The Ombudsman can recommend a firm pays more than the limit, but the firm does not have to accept that recommendation.

04

FSCS is a scheme of last resort with exclusions

For an investment firm that failed after 1 April 2019, FSCS can pay up to £85,000 per eligible person, per firm. FSCS cannot accept claims that are only about poor investment performance — the value of investments can go down as well as up. Claiming is free, but not everything is covered and not every firm is eligible.

05

Time limits can end a good claim

A firm complaint is normally barred after you normally need to complain within 6 years of the problem happening or, if later, within 3 years of becoming aware that you had cause to complain. the Ombudsman generally requires contact within you need to contact the financial ombudsman service within 6 months of receiving the firm’s final response, or it may not be able to help. and court claims face for negligence claims where the facts were not known at the outset, the limitation period is six years from the date the cause of action accrued, or three years from the date of knowledge — whichever expires later. there is an overriding fifteen-year longstop running from the act or omission alleged to constitute the negligence, which bars the claim even if the three-year knowledge period has not yet started to run.

06

Court carries a costs risk

Litigation is the only route where losing can cost you money beyond what you have already lost. Fee arrangements vary: ask for the deduction, the order in which deductions are taken, and what happens if the claim fails, in writing, before you sign anything.

07

Third parties are not us

We do not cold-call, we do not ask for documents by text, and we do not ask for bank details or passwords. If someone contacts you claiming to act for us, verify it using the details on our contact page before responding.

08

Investments can fall for reasons nobody is accountable for

A loss is not itself a claim. Investments can go down as well as up, and performance losses are generally not something FSCS or the Ombudsman can remedies. What matters is how the product was sold and what you were told.

If you are close to a deadline

Put the complaint in writing today and take advice on limitation immediately. A letter takes minutes and starts the process; advice on dates is worth an hour, because it decides whether the option still exists.
